Jury awards $1.48 million in mesothelioma death

The estate of a former Harnischfeger worker who died from mesothelioma was awarded $1.48 million in damages by a Milwaukee County jury last week.
John D. Pender (left, with grandchild) was a painter for Harnischfeger for nearly 40 years. He worked in an area where asbestos-laden dust from ground brake linings accumulated. He died in May 2006 at age 75.
Mesothelioma is a cancer caused by long-term exposure to asbestos.
Robert McCoy, attorney for the plaintiffs, said the jury found Pneumo Abex, the maker of the brake linings, 100% liable for sale of an unreasonably dangerous product, and 75% liable under a separate negligence claim. Harnischfeger was found 25% negligent, but the full award will come from Abex.
Jerome Feriancek, the Minnesota attorney for Abex, declined comment on the case Monday.
My mother inlaw has been diagnosed with Asbestos exposure and now has developed mesotheliomia. She is in her 70′s. Her father worked in the mine in the town of Calumet , or the school she attended could have had asbestos exposure. The only other possiblity, her husband, had worked for the city of Edina, for several years, for the water department. Such as, a watermain broke, he would need to crawl down in the hole and fix it. THen she would wash his clothes.
