W.R. Grace Trial Halted as Judge Molloy’s Ruling Overturned By Court of Appeals

By asbestoshub | March 3, 2009

So Andrew Schneider of the Seattle Post-Intelligencer has a blog. And it’s a doozy.

Schneider has followed the progress of W.R. Grace poisoning residents of Libby Montana since 1999 in a series called Uncivil Action: A Town Left to Die.

Today he reports that after U.S. District Judge Donald Molloy’s February 2009 ruling was overturned by the 9th U.S. Court of Appeals, Molloy suspended the trial. He had previously ordered that scheduled witnesses from Libby who were also victims of Grace’s alleged criminal action could not observe the trial.

Jurors are now to stay home until the government brings all of the 26 “victim witnesses” who have yet to testify. Each will have to testify before the Molloy without the jury.

Petulant Judge? You decide. Read the whole blog.
